Article 1- Application
These general terms and conditions of sale apply in the context of online sales service to all sales made through the sweetch.ch website.
Article 2 - Prices
Our products prices are indicated in Swiss Francs taxes included excluding participation in any shipping costs. All orders are payable in Swiss Francs.
Promotional prices : promotions are offered on our products for a specific period. Sweetch.ch reserves the right to modify its prices at any time, but the products will be invoiced based on the prices in force at the time of the order, subject to availability. The information relating to prices and product availability is subject to change and is given for information only.
Article 3 - Order
We are committed to accept your order in these terms and conditions of sale. On our website : sweetch.ch.
Article 4 - Validation
When you click on the submit button after the checkout process, you accept it as the integrality of these terms and conditions, fully and without reservation. The data recorded by sweetch.ch constitutes proof of all transactions by its customers. The data recorded by the secure payment system constitutes proof of financial transactions.
Article 5 - Availability
Our product offers and prices are valid within the limit of available product stock. The information on the availability of the products are provided on your order after adding the product to your cart. They are provided for information only. In case of unavailability of product after placing your order, we will notify you either by email or by phone. You can then cancel or exchange your order. In case of total unavailability of the product, your order will be cancelled and you will be refunded immediately. In case of partial delivery, our customer service will contact you to obtain your agreement for an exchange, refund or a lead time.
Article 6 - Delivery
The products are delivered to the shipping address you indicated during the order process.
The delivery time includes the packaging and the carrier delivery time.
The standard shipping method is Swiss Post's Priority for packages or letters, or DHL's Domestic Express Basic for packages. These various shipping methods do not require a customer signature and don't necessarily come with a tracking number. No refunds or returns can be claimed for the loss of the package once entrusted to the carrier.
In case of damage during transport, a written complaint must be made to sweetch.ch within three days of delivery. Sweetch.ch will then address the complaint to the carrier (within 15 working days) and will keep the customer informed of the progress. Once the damage is confirmed by the carrier, the order will be reshipped to you by sweetch.ch, free of charge (subject to stock availability, otherwise an alternative item will be proposed).
Delivery times are given for information only ; if they exceed thirty days after the order, the sale's contract may be terminated and the buyer refunded. Any product exchange, declared a posteriori, damaged during transport, without any complaints having been issued at the package reception, cannot be supported
If the address communicated by the customer is false or incomplete, no new material will be issued until the original is returned to our distribution centre. If sweetch.ch has to re-send the material, the shipping cost will be charged to the customer. No partial or total reimbursement will be possible.
In the event of a delay in delivery (from 5 working days), the customer is required to contact sweetch.ch in order to launch an investigation with the carrier. The standard investigation time is a maximum of 15 working days. Once the investigation is closed, if the package is considered lost by the carrier, sweetch.ch resends the order to the customer in full, against payment of the shipping costs. In this case, any refund is excluded. If the package is still considered by the carrier as still being in the process of delivery, see first paragraph.
Article 7 - Shipping
The shipping costs include a contribution to the packaging costs + postage. They are free when shipping within Switzerland on all orders above CHF 25.00. Remember to group all your items on a single order.
Article 8 - Payment
Credit card (swiss), Twint, PostFinance Card or PostFinance e-finance payments are accepted.
To avoid any risk of your credit card being misused, sweetch.ch commits never to give your order information to a third party.
Article 9 - Retention of title
The products remain the property of sweetch.ch until the full payment of the invoice, if any, plus interest. This disposition is not an obstacle to the transfer to the customer the risks of damage or loss starting when the products will have left the premises.
Article 10 - Liability
Sweetch.ch can not be held responsible in the event of a case of disruption, total or partial strike of postal services, transport and/or communications trouble, flood or fire.
Article 11 - Intellectual Property
All elements of sweetch.ch site are and remain the exclusive intellectual property of sweetch.ch. Nobody is allowed to reproduce, repost or use for any purpose whatsoever, even partially, elements of the site. This includes software, pictures, video or audio. Any single link or hyperlink is strictly prohibited without the express written consent of sweetch.ch.
Article 12 - Warranty Terms
The warranty does not apply to compensation for damage resulting from external causes (accident, dismantling and repair).
It also does not apply if the problem occurs in the use of a product which does not come from the website sweetch.ch or has been misused (with incompatible accessories or poor maintenance). The products sold by sweetch.ch are guaranteed in the manner and the warranty period offered by the manufacturer.
Procedure in case of initiation of coverage:
- Beforehand, you will need to contact our customer service in the contact section of the site.
- The product must be returned to us as a whole and in its original packaging with the reference order to the following address: Sweetch Sàrl, Route de Champ-Colin 2c, 1260 Nyon.
- Your products will be tested by our technicians to determine the cause of the failure.
- If all warranty conditions are met, then the defective parts will be changed (subject to stock availability, otherwise a replacement item will be suggested) and the shipping costs will be credited to you in the form of a voucher on your customer account.
- If the products are not defective, but the problem is how to use the product, the return costs are at the charge of the customer and are payable in advance.
Article 13 - Return merchandise
In accordance with Article 40e para. 2 of the Code of Obligations, the consumer has a period of 14 calendar days to return, at his expense, the products ordered. This right only applies to natural persons. This period starts from the day of the order.
Any return must be reported, in advance, to our customer service.
In exchange, the buyer will receive a refund within a maximum period of 30 days.
Consumables such as e-liquid bottles will not be returned or refunded. Only products returned as a whole, in their complete intact original packaging and in perfect condition for resale will be taken back. Any product that has been damaged or whose original packaging has been damaged, will not be refunded, returned, or exchanged.
This right of withdrawal is exercised without penalty, except for shipping and return costs.
In the event of the exercise of the right of withdrawal, the consumer has the choice to request either a refund of the sums paid or an exchange of the product.
In the case of an exchange, the reshipment will be at the expense of the consumer.
Article 14 - Loyalty program
Sweetch.ch's loyalty program is based on points acquisition for each approved order.
For each CHF 15 spent (excluding shipping costs), one loyalty point will be automatically awarded to you. Points accumulate in your account. It is possible to use them (partially or totally) with your next order.
Each point turns into a voucher of CHF 0.50. This loyalty program allows you to multiply the rewards, according to the methods described on the loyalty page of the customer account.
Please note that our internet loyalty program is independent from the one practiced in the shops.
Article 15 - Contest participation conditions
- Contests participation is free and with no purchase obligation.
- All individuals aged 18 and over can participate.
- Sweetch employees and their family cannot participate in the contest.
- Each participant is allowed to enter the contests only once.
Terms and Conditions of contests
- The draw will be conducted by the online marketing team. Winners will be notified within 7 working days after the end of the contests.
- The winners will be drawn at random at the end of the contests from all the forms received and notified by e-mail.
- Prizes cannot be transmitted or paid for in cash.
Problems in the process, responsibility
- Sweetch disclaims any responsibility for data loss and other technical defects, especially with the transmission of data.
- If a winner cannot send their contact information within 7 business days or if a prize cannot be awarded, the participant can no longer claim his price. In this case, the winner renounces any subsequent claim.
The competitions are governed by Swiss law and exclude any modality of private international law. Any judicial remedy is excluded. There will be no correspondence regarding these competitions.
